General conditions

Registered users can use our Service to send campaigns to known contacts. SPAM messages are strictly prohibited at all times.

Our Definition of Illegally Collected Mailing Lists

A mailing list is legitimate if recipients have consented to receive messages. Illegal collection methods include renting/buying addresses, using information extraction software, collecting from public resources like Yellow Pages, and collecting emails during phone calls without explicit consent.

A mailing list is legit if the recipient agreed to receive email messages from you.

The illegal ways of collecting mailing lists are:


  • Renting/buying email addresses and phone numbers from a third party.

  • Collecting email addresses and phone numbers from Yellow Pages, online directories, etc.

  • Getting email addresses and phone numbers with the help of information extraction software.

  • Collecting email addresses from business cards and questionnaires.

  • Collecting email addresses during phone calls with customers. Often, sales managers use this method.

  • Collecting email addresses that indicate the role of the recipient like info@domain.com, faq@domain.com, and similar ones.

Our Definition of Spam

We define SPAM as any unsolicited, unexpected, or unwanted message sent with the intent to deceive recipients or without their prior consent. Users of EliCell must ensure that all communications adhere to the following standards:


  • Avoid using false, invalid, or misleading information in the subject line or body of the message.

  • Obtain explicit consent from recipients before sending messages.

  • Ensure the text clearly describes or illustrates the service being offered.

  • Marketing campaigns must transparently disclose the identity of the provider (originator) and clearly indicate the cost of the service.

  • It is strictly prohibited to send messages using mailing lists that have been illegally acquired via EliCell's SMTP servers. Additionally, the use of temporary email addresses as sender email addresses is forbidden.

Our Definition of SMS Spam

We define SPAM as any unsolicited, unexpected, or undesirable SMS message sent to extort or deceive recipients, or any message from an unauthorized sender. Users of the EliCell Service are explicitly prohibited from sending SPAM. All SMS communications via EliCell must adhere to the following guidelines:


  • Ensure that all information within the SMS is accurate and not misleading.

  • Obtain explicit prior consent from recipients before sending SMS messages.

  • Clearly articulate the nature of the service being offered in the message content.

  • Transparently disclose the identity of the service provider (originator) and the costs associated with the service in any marketing communications.

  • Sending messages to mailing lists that have been illegally compiled is strictly prohibited on EliCell's SMS servers.

What content is prohibited

Our Service prohibits spam and any form of offensive or illegal content. Specifically, we do not permit:


  • Email, SMS, Web Push, and chatbot campaigns for Facebook, Telegram, and WhatsApp that violate the CAN-SPAM Act.

  • Sexually explicit messages.

  • Hate speech

  • Marketing campaigns targeted at individuals who have not given their permission.

We conduct thorough reviews of each user profile to ensure compliance with our Terms of Service and maintain high deliverability standards for all our clients.

Please be aware that certain industries or niches may generate more abuse and spam complaints than others. Protecting our servers' reputation is crucial as it impacts every user.

Our Service rejects campaigns and does not host websites associated with the following types of services, products, or content:


  • Escort and dating services,

  • Online and direct sales of pharmaceuticals, including health and sexual well-being products, prescription and counterfeit drugs,

  • Work from home," "make money online," and "lead generation" opportunities promising quick riches,

  • Adult novelty items or references,

  • Illegal goods, pirated software or media,

  • Betting and gambling services, including online poker, casino games, and betting on sporting events,

  • Tobacco and alcohol products,

The content of your campaigns must align clearly with your sender email address and domain. Our administration diligently monitors whether EliCell is flagged by any popular RBL services. Campaigns causing our IP addresses or domains to be blacklisted will be immediately suspended.

Anti-Spam Policy Enforcement

Non-compliance with our Anti-Spam Policy will result in immediate cessation of service and possible legal action to ensure compliance.

Your Right to Cancel / Money Back Guarantee


  • If your account is cancelled or suspended due to SPAM complaints, no refund will be allowable. See details in our Terms of Service.

  • Make sure all recipients are permission based emails (opt-in emails), i.e. agreed to receive email messages from you.

  • It is strictly forbidden to send emails to the list of email addresses that was generated automatically by email extractor software; likewise you are not allowed to use purchased email addresses for bulk mailings.

  • You must ensure that your email meets the requirements of the CAN-SPAM Act — pay attention to the statement that each email you send with the advertising, commercial, and informative purpose must contain your valid physical address.

  • We reserve the right to stop providing service and block user account if even one of your email campaign gets over-the-top complaints.

  • If you don’t use your account for 9 months, it is considered inactive. In this situation we may stop providing service and delete your account

Accounts blocked due to exceeding complaints are denied in getting a refund.

The limit of non-existing addresses is 7%. If the number of non-valid addresses (non-existent, not active addresses) exceeds, email campaign can be blocked by Service moderators. To avoid being blocked, verify email addresses using EliCell email verification service or other verification services/programs before sending an email campaign.

We understand that there can be a certain number of complaints if you send bulk email messages. According to our Service terms and conditions, we specified the level of a permitted complaints as no more than 0.4% per sender domain for a single email campaign. In addition, we take into consideration different factors like the amount of sent emails as well as complaints ratio and types of complaints. The amount of unsubscribes should not exceed 1% of the mailing list. However, if your email campaign gets a ratio that exceeds the permitted level, we reserve the right to block or terminate your account without a refund.

SPAM and Abuse Reporting

Please report any abuse or unsolicited messages to us. In your report, include the offending email, along with the date and time it was received. You can send this information to support@EliCell.com. Any email address that is the subject of spam complaints will be temporarily suspended while we investigate the matter.

Choice of Law Arbitration

All legal relations between the user and EliCell are governed by the laws of the State of Texas. Disputes arising from these Terms will be adjudicated in the state and federal courts of Texas, to which parties consent to jurisdiction.

EliCell guarantees that any actions regarding Personal Data are carried out in full compliance with this Policy and the principles set forth in the EU GDPR.
